BATAVIA — A Batavia man in jail for assaulting a woman twice in a four-hour period last month faces new charges for again violating an order of protection.
John Sumlin III, 43, was charged Tuesday with five counts of felony criminal contempt of court, Genesee County sheriff’s deputies said.
Sumlin is in Genesee County Jail and is accused of violating the order of protection by contacting the woman by phone five times, deputies said. Calls from jail are monitored by officers.
Sumlin was jailed Oct. 23 after he broke into the woman’s house and held a knife to her neck. Deputies said he threatened to kill her and her children.
Sumlin was charged by deputies with first-degree burglary, a violent felony offense punishable by up to 25 years in prison, felony criminal contempt of court, felony criminal mischief and misdemeanor counts of third-degree assault and menacing.
The woman had an order of protection against Sumlin that was put in place an hour earlier.
City police responded to a complaint at 1:46 a.m. that same morning. Sumlin was accused of hitting the woman, his girlfriend, in the neck during an argument.
He was charged with harassment and possession of a controlled substance in that case and was released from custody.
